You have had enough of the Melbourne traffic and the soaring cost of living.
You find a beautiful, cheap 5-acre block in regional Victoria.
The plan is simple: Buy the land, tow a custom-built Tiny Home onto the property, install solar panels, set up a water tank, and live completely “Off-Grid.” No mortgage stress. No utility bills.
You move in. The birds are singing.
Three weeks later, a council compliance officer knocks on your door and hands you an eviction notice.

Welcome to the legal grey area of alternative living. In 2026, the Tiny Home movement is booming, but the law is struggling to keep up. Here is what you need to know before you buy land for your off-grid dream.

1. The “Vehicle vs. Dwelling” Loophole
Many Tiny Home builders sell their products on wheels (THOWs—Tiny Homes on Wheels).
They will tell you: “It has wheels, so it’s legally a caravan. You don’t need a building permit!”
The Legal Reality: While it might be a caravan when it is driving down the Princes Highway, the moment you park it and live in it permanently, Victorian councils classify it as a “dwelling.” And dwellings require planning and building permits.

2. The Postcode Lottery: Council by Council Rules
There is no single statewide law for Tiny Homes in Victoria. It is a postcode lottery.

The Progressive Councils: Some regional councils (like Mount Alexander or the Surf Coast) have introduced trials and relaxed local laws allowing you to live in a Tiny Home on someone else’s land with a simple permit.

The Strict Councils: Other councils will actively hunt down unpermitted Tiny Homes through satellite imagery and neighbor complaints, issuing hefty fines and removal orders.

3. The Vacant Land Trap: Zoning Matters
You cannot just buy a block of dirt and live on it.
If the land is zoned Farming Zone (FZ) or Rural Conservation Zone (RCZ), the council may strictly prohibit building a dwelling unless the land is over a certain size (often 40 hectares/100 acres).
If you buy a 2-acre block in a Farming Zone hoping to live off-grid, you might find you are legally forbidden from sleeping there.

4. Off-Grid Compliance: It is Not Just Solar
Going off-grid isn’t just about throwing some solar panels on the roof.
To get a permit to live on a property, you must satisfy health and safety regulations.

Wastewater: You cannot just run a pipe into the bush. You need an EPA-approved septic system or composting toilet, which requires a specific council permit.

Bushfire (BMO): Many beautiful rural blocks are in a Bushfire Management Overlay. Your Tiny Home must meet strict (and expensive) fire safety ratings, and you must have a dedicated water tank just for the CFA.

5. The Section 32 Danger: Buying a Property WITH a Tiny Home
What if you are buying a property that already has a Tiny Home on it?
The Risk: Is it a fixture (included in the sale) or a chattel (the vendor can tow it away before settlement)? More importantly, did the vendor get council approval for it? If you buy a property with an illegal dwelling, you inherit the legal problem the moment the property settles.
