You want to buy an investment property. You read the headlines: Victoria is spending over $100 billion on the “Big Build.”
You think, “If I buy a house near a new train station or a tunnel, the value will skyrocket, right?”
You find a great property in Watsonia. You sign the contract.
A week later, you receive a letter from the State Government. The property is sitting on a “Public Acquisition Overlay” for the North East Link. They are legally seizing part of your backyard to widen the road.

Welcome to the 2026 infrastructure boom. While major transport projects like the newly opened Metro Tunnel and the Suburban Rail Loop are generating massive capital growth in specific suburbs, they also carry severe legal risks for buyers.

Here is where the smart money is going in 2026, and the legal traps you must avoid.

1. The Metro Tunnel Effect (The “Live” Winners)
With the Metro Tunnel now fully operational in 2026, the promised “turn-up-and-go” service is finally a reality.
Suburbs at the ends of the Cranbourne, Pakenham, and Sunbury lines are experiencing the biggest “commuter premium.”

Sunshine: Fast-tracked as a transport super-hub connecting the west, regional rail, and future airport links, Sunshine is seeing massive gentrification.
Footscray & Arden: Proximity to the new CBD underground stations is driving intense demand for both established housing and new townhouses in these inner-west pockets.

2. The North East Link (NEL) Corridor
With the massive tunnel boring machines “Zelda” and “Gillian” breaking through in 2026, the end of the $26 billion North East Link project is in sight (expected 2028).

4. The Hidden Legal Trap: The PAO
This is where buyers get burned.
When the government builds infrastructure, they need land. If your property falls under a Public Acquisition Overlay (PAO), the government has the legal right to forcibly acquire your land (or part of it).
Even if they don’t acquire it, a PAO makes it incredibly difficult to get a building permit for your own renovations, and severely limits your resale value to future buyers.

The Verdict
Following the infrastructure trail is one of the safest ways to generate capital growth in Victoria. However, the closer you buy to the action, the higher the risk of restrictive overlays and compulsory acquisition.
